The Health and Safety Commission ("HSC") and the Health and Safety Executive ("HSE") are responsible for safeguarding employees and the public from all health and safety work place risks in the UK.

The HSE's investigation and enforcement powers are considerable. They are designed to hold duty-holders to account for breaches of legislation and promote sustained compliance with health and safety legislation.

We assist Insurers and their Policyholders navigate their way through the wealth of Health and Safety legislation. We advise on potential HSE prosecutions, investigations. We assist Policyholders in mitigating the costs and consequences of breaches of the legislation.

HSE enforcement is distinct from civil claims brought by victims of health and safety accidents, but there is a delicate balance between the two. Robin Simon LLP is well experienced in finding that balance.

Examples of our work include:

  • Advice to D&O and PI insurers on policy coverage in possible conflict situations where the HSE are investigating and contemplating prosecution of both the company and individual directors.
  • Attendance with policyholders at HSE interviews under caution in accordance with the provisions of The Police and Criminal Evidence Act 1984 ("PACE").
  • Preparation for and representation of Policyholders at prosecution hearings in the Magistrates' and Crown Courts.
